GTC
1. Scope of application
The general terms and conditions (hereinafter referred to as “GTCs”) cover all legal transactions concluded via the website hr-translationservice.ch. SchelPart AG may change these GTCs at any time. The version valid at the time of the order shall prevail in each case.
2. Services
SchelPart AG orders a certified commercial register extract from the Commercial Register Office Zug, which is translated by an employee (only active entries). Upon request, this translation can be provided with a certification (signature certification) and an apostille.
The products and prices are considered an invitation to offer to customers. The orders of the customers are considered as offers, which SchelPart AG can accept by order confirmation by email. The prices quoted during the ordering process are binding for the customer. SchelPart AG assumes no guarantee and liability for the unrestricted availability of the website and the ordering system.
3. Price and Terms of Payment
The prices for the services are shown on the website. Unless otherwise stated, all prices are exclusive of VAT. Payment is made by invoice. Advance payment is required for orders from abroad.
Invoice amounts are to be paid within the period specified on the invoice. In case of late payment, default interest and reminder fees of CHF 30.00 must be paid.
If payment terms are not complied with, SchelPart AG is entitled to
· to make all claims against the customer immediately due, or
· to demand collateral for all outstanding claims and/or
· outstanding deliveries only against prepayment.
SchelPart AG is not responsible for technical difficulties and errors in connection with payment by third parties.
4. Shipping
At the choice of the customer, the ordered translation shall be sent either by post (A-Post) or electronically to the address specified by the customer in Switzerland or Liechtenstein. Shipping to other countries is only possible on request and against additional compensation.
SchelPart AG processes orders received as quickly as possible and endeavours to deliver the products within the specified deadlines. The delivery times depend on the opening hours of the Commercial Register Office Zug. They are therefore without guarantee. Orders for translations without express surcharge are generally delivered within 3 to 4 working days. Orders for translations with express surcharge are generally delivered within 2 to 3 working days (considering the cantonal holidays).
SchelPart AG is not responsible for all delivery delays or technical difficulties and errors in the transmission or receipt of ordered extracts and documents.
5. Liability
Claims for damages against SchelPart AG and its auxiliary persons in the event of slight negligence are excluded, with the exception of mandatory statutory provisions.
6. Final Provisions
The place of jurisdiction is, subject to mandatory legal provisions, the registered office of hr-translationservice. However, SchelPart AG may also call the court at the customer’s registered office. Swiss law is exclusively applicable.
